Industrial Designs

1. What is an industrial design?
ìIndustrial designî means features of shape, configuration, pattern or ornament applied to an article by any industrial process or means, being features which in the finished article appeal to and are judged by the eye.

2. When is an industrial design registrable?
An industrial design is registrable if it is new: It is not new, if before the priority date of the application it was disclosed to the public anywhere in Malaysia or it has been the subject matter of another application for registration of the design in Malaysia.

3. What are the restrictions against registration of an industrial design?
An industrial design may not be registered if it is:-
  • defined purely by its functional purpose;

  • dependent upon the appearance of another article of which the article is intended by the author of the design to form an integral part; and

  • contrary to public order or morality.
4. Who may apply for registration of an industrial design ?
The owner of an industrial design may apply for registration of his industrial design or he may do so through an industrial design agent.
