1. What is a mark?
A mark is a device, brand, heading, label, ticket, name, signature, word, letter, numeral or any combination of these items.

2. What is a trade mark?
A trade mark is a mark used or proposed to be used in relation to goods or services to indicate a connection in the course of trade between a trader and his goods.

3. What is a registrable trade mark?
A registrable trade mark is: -
  • the name of an individual, a company or firm represented in a special manner;

  • the signature of an applicant;

  • an invented word;

  • a word having no direct reference to the character or quality of the goods or services to which it is to be registered;

  • not a geographical name or a surname; or

  • any other distinctive mark.
