Trade Mark
  • representations or mottoes of the royal or imperial crowns, or the royal, imperial or national flags;

  • representations of mottoes of the crests, armorial bearings or insignia of the Malaysian Army, Navy, Air Force and Police;

  • features likely to deceive or cause confusion to the public;

  • scandalous or offensive matter;

  • matters prejudicial to the interest or security of Malaysia;

  • identical features of a well-known mark in Malaysia; and

  • identical features of a registered trade mark belonging to a different proprietor.
5. Who may apply for registration of a trade mark?
The owner of a trade mark may apply for registration of his mark OR he may do so through a trade mark agent.
