6. What particulars must be supplied by the applicant to register his trade mark?
The applicant must provide:-
  • his name and address;

  • if it is a partnership, the name of the partners and the trading style;

  • the goods/services and the classes to which they belong;
  • representation of the mark;

  • a statutory declaration to the fact that he is the bona fide owner of the trade mark;

  • the translation/transliteration of non-English words on the trade mark;
  • the date of its first use in Malaysia, if any;
  • and certified copies of priority documents, if any.
7. How do you determine to which class the goods/services belong?
The applicant may refer to the Third Schedule of the Trade Marks Regulations 1997 to ascertain the class to which the goods/services belong.
